Compensation for Overtime Work
Daily overtime work is compensated by paying the employee a salary increased by 50% for the first two hours of overtime work and a salary increased by 100% for any additional overtime work. Weekly overtime work is compensated by paying the employee a salary increased by 50% depending on the amount of overtime worked during the week. These rules are mandatory and may only be departed from in collective agreements.
Overtime work may also be agreed to be compensated by additional holiday, in which case the same percentage enhancements must be applied. The employee must be allowed to take out the holiday within six months of the overtime worked and if it is not possible to arrange this, the employee must receive a monetary compensation for the overtime work. The employer and the employee should agree upon when the employee can use his/her free time. If they cannot agree, the employer shall be entitled to set the time, unless the employee demands the compensation in money.
Senior officials and all employees who work in a managing position may agree to receive a fixed compensation for overtime work. For further information, see [2.5.1.11 Fixed Monthly Compensation].
