    Compensation for Overtime Work

    Daily overtime work is compensated by paying the employee a salary increased by 50% for the first two hours of overtime work and a salary increased by 100% for any additional overtime work. Weekly overtime work is compensated by paying the employee a salary increased by 50% regardless of the amount of overtime worked per week. These provisions are mandatory and only be derogated from by collective agreement.

    Overtime work may also be agreed to be compensated on a time-off basis, in which case the same percentage enhancements must be applied. The employee must be allowed to take time off within six months of the overtime worked and if it is not possible to arrange this, the employee must receive a monetary compensation for the overtime work. The employer and the employee should try to agree on the timing of the time off. If they cannot agree, the employer shall be entitled to set a date and time, unless the employee demands monetary compensation.
