Termination Grounds Related to the Employee's Person in General
The employer may have to terminate an employment relationship based on grounds related to the employee’s person. An employment agreement is terminated either by termination or cancellation. The seriousness of the employee’s breach or neglect determines whether the employment agreement is terminated or cancelled. From an employee perspective, cancellation is a more severe consequence than termination. When the employer cancels the employment agreement, the employment relationship ends immediately. When the employer gives the employee notice, the employment relationship terminates after the employee’s notice period. Ordinarily and as a rule, employment relationships are terminated whereas cancellation is reserved only for extreme situations.

The severity of the grounds determinates whether the employer can cancel the employment relationship to end immediately or terminate the relationship to end after the notice period. An alternative to the termination or cancellation of the employment agreement, is that the employer and the employee agree that the work obligation of the employee and the employer’s payment of pay is suspended for a while.
