Notification Procedures Regarding Non-Recurring Activities
A company must submit a notice to the environmental authority on certain temporary actions under the conditions stipulated tn the Environmental Protection Act.
A written notice is required when the activity causes temporary noise or vibration or when there is reason to expect that such noise or vibration will be especially disturbing. In such events the operator shall notify the municipal environmental protection authority.
Secondly, a notification is required for a short-term activity undertaken on an experimental basis when the purpose is to test an emerging technique, raw material or fuel, a manufacturing or incineration method or treatment equipment, or to treat waste at an installation or on a professional basis to investigate the impact, feasibility or other corresponding feature. The competent authority which shall be notified is the same instance that would be addressed if the procedure would require an environmental permit. Based on the notification, the authority shall grant a decision containing necessary specifications to prevent pollution in the activity. If the activity is continued after the experimental phase, the operator is required to obtain an environmental permit or notify the authority according to the general notification procedure or register the activity depending on the scope of advance control entailed in the Environmental Protection Act. A notification is required also for other exceptional, temporary activities or situations that have an impact on the environment.. Cause for such can be accidents, unanticipated production failures or other comparable unexpected reasons independent of the activity itself. Additional requirement is that the exceptional situation may cause emissions and so presents an immediate and apparent risk or environmental pollution, or it may require extraordinary waste management operations because of the quantity or properties of the waste. The notification is submitted to the municipal environmental protection authority.
