The Commencement of the Insurance Company’s Liability
The insurer’s liability begins, when the insurer or the policy holder hands in or sends an acceptance of the other party’s offer. The beginning of the liability can also be agreed separately. If the policy holder has handed in or sent a written insurance application to the insurer and it is evident that the insurer would accept the application, the insurer is also liable for the occurrence of an insured event taking place after the handing in or sending of the application.
The terms and conditions of insurance may, however, regulate that due to a specific reason the liability only begins once the insurance payment has been made. In order to be able to refer to this condition, the insurer has to make a note of this condition to the insurance payment invoice.
