The Commencement of a Personal Insurance

Where a personal insurance is concerned, the insurer may not reject an insurance application on the basis that an insured event has taken place or that the health of the person to be insured has deteriorated since the giving or sending of the insurance documents to the insurer. If the insurance payment or other terms and conditions of contract are based on the insured person’s health, the basis for determination shall be the state of health that existed at the time when the insurance documents were given or sent to the insurer.
