Buyer's Right to Demand a Reduction in Price
If the buyer is willing to accept defective goods, they are entitled to a price reduction. This entitlement remains if rectification of the defect or a new delivery is impractical or not executed within a reasonable timeframe. A price reduction serves to offset the impact of the defect, which need not be significant; even a minor defect warrants a reduction. The buyer must initiate the request for a reduction, which should correspond to the diminished value of the defective goods.
The buyer is responsible for initiating the request for a price reduction, although the seller may also proactively offer a reduction to mitigate other potential consequences and maintain positive customer relations.
