Buyer’s Delay
When the buyer fails to make the payment on time, the breach in question is late payment. Late payment constitutes a breach of contract. If no set time of payment has been agreed, the price must be paid upon the seller’s request.
Failure to collect the product on time is also considered late performance on the buyer’s part. However, this is usually regarded as a defect, not delay, on the buyer’s part. The difference is rather theoretical, but the most important thing to remember is that cooperation can be demanded of the buyer also in relation to the delivery and receipt of goods.
